We warrant that Wallace Cranes (Wallace) products manufactured by us will be of the kind and quality described and will be free of defects in workmanship or material. Should any failure to conform to this warranty appear within one (1) year, we shall upon notification correct such non-conformity, at our option, either by repairing any defective part or parts, or by making available, F.O.B. Frazer, Pennsylvania, a repaired or replacement part.

All gantry returns must be made within forty-five (45) days from date of shipments and are subject to a 15% restocking fee, unless the return is for an exchange. All returns must be shipped freight prepaid. Additional deductions may be made for physical damage to the gantry.

Any improper or excessive use, operation beyond capacity, substitution of parts not approved by us, or any alteration or repair by others which in our opinion affects the gantry or accessories materially and adversely shall void this warranty.

Wallace shall not be responsible for unauthorized sale or misrepresentation by unauthorized 3rd party resellers. Wallace warranties are not transferable with ownership. Products purchased at auction are not covered under Wallace warranty.

THIS WARRANTY IS IN LIEU OF ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE, OR OTHER WARRANTIES, EXPRESS OR IMPLIED, EXCEPT OF TITLE AND AGAINST PATENT INFRINGEMENT. Correction of non-conformities, in the manner and for the period of time provided above, shall constitute fulfillment of all our liabilities to you, whether based on contract, negligence or otherwise with respect to, or arising out of such gantry or use thereof.

We shall not be liable for special, indirect, or consequential damages. The remedies set forth herein are exclusive, and our liability with respect to any sale or anything done in connection therewith, whether in contract, in tort, under any warranty, or otherwise, shall not, except as expressly provided herein, exceed the price of the equipment or part on which such liability is based.

This warranty is not transferable and is applicable only for the original purchaser of the equipment and does not extend to subsequent resale.

Terms: Net 30 days with credit approval (Finance charge after 30 days 1.5% mo., 18% yr.), or for your convenience, we also accept VISA and MASTERCARD.

OSHA: Wallace products are manufactured in accordance with our interpretation of the American National Standards Institute and U.S. Occupational Safety and Health Administration (section 1910.179, revised January 1976) regulations at the time of manufacture. Users should also check each installation for compliance with the applicable local operating and maintenance requirements of this law.
